TUCSON, Ariz. (AP) – The head of the U.S. Customs and Border Protection says justice was served after two men were convicted in the murder of
Border Patrol agent Brian Terry.

CBP Commissioner Gil Kerlikowske issued a statement on Friday, one day after 37-year-old Ivan Soto-Barraza and 26-year-old Jesus Leonel Sanchez-Meza were convicted of murder in federal court in Tucson. CBP is the parent agency of the Border Patrol.

Kerlikowske said the verdicts can’t soothe the pain of the loss of Terry, who was 40 years old when he was fatally shot on Dec. 14, 2010. But they can help bring closure.

Terry’s death exposed a bungled gun sting in which federal agents allowed criminals to buy guns with the intention of tracking them. But it lost most of the guns, including two that were found at the murder scene.

UPDATE: Oct. 2nd, 10:37 a.m.

ROSEBURG, Ore. (AP) – A federal agency says the gunman who killed nine people at an Oregon community college had body armor and was armed with three pistols, a rifle and five additional magazines.

The Bureau of Alcohol, Tobacco, Firearms and Explosives provided the information late Thursday in an incident report obtained by The Associated Press. The guns included a 9 mm Glock pistol and .40-caliber Smith & Wesson, both traced to the suspect.

He also had a .40-caliber Taurus pistol traced to someone in Portland and a .556-caliber Del-Ton.

The shooting, Thursday, at Umpqua Community College also wounded seven. Officials identified the killer as Chris Harper Mercer. He died after a shootout with police.

He isn’t believed to have a criminal history. Investigators believe he may have been a student there because a receipt found at the scene showed he purchased textbooks from the campus bookstore two days before the shooting.

Social media profiles linked to Mercer suggested he was fascinated by the Irish Republican Army (IRA), frustrated by traditional
organized religion and tracked other mass shootings.

There didn’t seem to be many recent connections on the social media sites linked to Mercer, with his MySpace page just showing two friends. He appeared to have at least one online dating profile.

On a torrents streaming site and blog that appeared to belong to Mercer, posts referenced multiple shootings and downloads included several horror films and a documentary on a mass shooting at Sandy Hook Elementary School in Newtown, Connecticut.

A blog post urged readers to watch the online footage of Vester Flanagan shooting two former colleagues on live TV in Virginia, while another lamented materialism as preventing spiritual development.

A MySpace page that appeared to belong to Mercer included several photos and graphics of the IRA as well as a picture of Mercer
holding a rifle.

UPDATE: 3:58 P.M.

ROSEBURG, Ore. (AP) – A student at the Oregon community college where a mass shooting occurred says the gunman shot her teacher and asked others in her classroom about their religion before spraying more bullets.

Eighteen-year-old Kortney Moore of Rogue River tells the Roseburg News-Review newspaper that she was in a writing class at Umpqua (UHMP’-kwah) Community College in Roseburg on Thursday when a shot came through a window.

The gunman entered her classroom and told people to get on the ground.

Moore says the man started asking people to stand up and state their religion and then opened fire.

The shooting left 13 people dead and at least 20 injured.

Douglas County Sheriff John Hanlin says authorities responded and exchanged gunfire with the man. He says the shooter died at the scene, but he didn’t say whether the man killed himself or was shot by police.

—————————————————————————————————————————————————————————-

ROSEBURG, Ore. (AP) – Douglas County Sheriff John Hanlin says the 20-year-old shooter is dead.

At least seven people are confirmed dead and 20 injured today in a shooting at a community college.

The shooting happened at Umpqua Community College in Roseburg, about 180 miles south of Portland. The local fire district advised people via Twitter to stay away from the school. It later tweeted that there were “multiple casualties,” but didn’t elaborate.

A state police lieutenant told KATU-TV that seven to 10 people were dead and at least 20 others were injured. A photographer for the Roseburg News-Review newspaper said he saw people being loaded into multiple ambulances and taken to the local hospital.

Umpqua Community College has about 3,000 students.

PHOENIX (AP) – The latest on a series of freeway shootings in the Phoenix area (all times local): 9:08 a.m.

A man charged in some of the freeway shootings that rattled the Phoenix area has pleaded not guilty.

A judge entered the plea for Leslie Allen Merritt Jr. during a brief arraignment Thursday. The 21-year-old Glendale man has been charged with aggravated assault, carrying out a drive-by shooting and other crimes.

Merritt didn’t say anything at the hearing other than to give his name and date of birth.

Investigators say ballistics tests link him to four of 11 shootings that occurred on Phoenix-area freeways between Aug. 22 and Sept. 10. Merritt was arrested Sept. 18 at a Wal-Mart.

The investigation into the other shootings remains open. State police say copycats may be responsible.

Authorities say eight cars were struck with bullets and three with projectiles such as BBs or pellets.

PHOENIX (AP) – A state audit of Arizona’s Department of Child Safety (DCS) has found that the agency’s process of removing children from homes is
inconsistent and may result in unnecessary child removals.

According to the report released Wednesday by the state Auditor General, the agency doesn’t have a uniform set of guidelines for caseworkers to follow when evaluating a child’s safety risk. Case workers write descriptions of what they’ve observed, but a lack of specific criteria could lead to poor decision-making, the audit states.

The report also noted a lack of services to support families and children as well as inadequate training for supervisors and caseworkers.

A DCS spokesman says the agency agrees with the report and will make improvements based on its recommendations.

PHOENIX (AP) – The Arizona Board of Education is suing to force Superintendent of Public Instruction Diane Douglas to give remote computer access to board investigators and to redirect web traffic to the board’s new website.

The lawsuit announced Wednesday comes two weeks after the board authorized its attorneys to sue the state’s top school official for failing to comply with board policies.

The Board and Douglas have been at odds since she tried to fire the board’s executive staff in February. Ongoing friction between the board that sets state school policy and Douglas led the board to move its staff out of Douglas’ offices.

The lawsuit seeks a declaration that Douglas is breaking the law by failing to execute board policies and orders requiring her to comply.

PHOENIX (AP) -Sheriff Joe Arpaio is scheduled to testify Wednesday about his acknowledged disobedience of court orders in a racial profiling lawsuit as well as an alleged investigation involving the case’s judge.

Arpaio faces the contempt-of-court hearings over his decision to let his officers conduct immigration patrols 18 months after they were told to stop them.

Other subjects to be examined include an allegation that Arpaio launched an investigation of the profiling case’s judge in a failed bid to get him disqualified.

Arpaio could face fines, and later he’ll be called into criminal court on similar grounds.

U.S. District Judge Murray Snow has said the investigation was intended to show an alleged conspiracy between him and federal authorities pressing another lawsuit against Arpaio.

Arpaio denies he was investigating Snow.

TUCSON, Ariz. (AP) – The trial of two men in the killing of a Border Patrol agent during a 2010 shootout in the Arizona desert is winding down in federal court in Tucson.

Prosecutors rested their case Monday and the defense did so Wednesday without calling any witnesses. A prosecutor argued during closing statements Wednesday that DNA and fingerprint evidence, along with confessions from both defendants, proves they are guilty on all nine counts. The defense will follow with its closing statements.

Jury deliberations are expected to start later Wednesday.

Jesus Leonel Sanchez-Meza, also known as Lionel Portillo-Meza, and Ivan Soto-Barraza are accused of belonging to a “rip crew” that were planning to rob drug smugglers when they encountered Brian Terry and other agents. A gunfight ensued and Terry was killed.

The case exposed the bungled federal gun operation known as Fast and Furious. Two of 1,400 guns lost in the operation were where Terry was killed.

PHOENIX (AP) – Democrats in the Arizona Legislature are proposing a school funding plan that relies on surplus state money and puts more cash into schools than Republican Gov. Doug Ducey’s plan to tap the state land trust.

Tuesday‘s announcement from the minority party comes as GOP leaders in the Legislature and the governor work on proposals that could be taken up in a possible special legislative session in October.

The Democratic plan provides enough cash to settle an ongoing lawsuit by schools. A judge has ordered the Legislature to pay $336 million this year but Republicans are appealing. It puts $3.8 billion in new money into schools over 10 years without raising taxes.

Ducey spokesman Daniel Scarpinato called the Democrats’ proposal “a 10-year spending plan with no way to pay for it”.
